E - Contract:

AFFIDAVIT OF VOLUNTARY PARTICIPATION & INFORMED CONSENT

These terms and conditions are construed, agreed, signed and executed in accordance with the model guidelines on direct selling issued by the Govt. of India, Ministry of Consumer Affairs, Food & Public Distribution, Department of Consumer Affairs vide F. No. 21/18/2014-IT (Vol-II) dated 9th Sept., 2023 read with Indian Contract Act, 1872, which supersedes any prior terms and conditions, discussions or agreements between the Company and the direct seller entering in to this agreement.

Now this agreement is signed, agreed and executed by and between

BE SELLFISH EDUCATION & ENTREPRENEURSHIP LLP, which is a company incorporated under Companies Act, 2013, having its registered office at 9/617, Sudama Nagar, Sonipat-131001 (Haryana)

WHEREAS

1. The Company is engaged in providing skill development courses and a network marketing opportunity.
2. The Distributor wishes to voluntarily participate in the Company's program
3. Both parties intend to ensure complete transparency and voluntary participation

AND

The Person / Entity who has filed the online application form available on Companies Website shall unless repugnant to the context or meaning there of be deemed to mean and include his / her/ their legal heirs, executors, administrators and assignees of both the parties.

Whereas the first party is a registered company under Companies Act, 2013, and the second party is willing to work with the first party under full compliance of the Indian contact after fully compliance of the Indian Contract Act, 1872, read with the guidelines as provided by Govt. of India, Ministry of Consumer Affairs, Food & Public Distribution, Department of Consumer Affairs vide F. No. 21/18/2014-IT (Vol-II) dated 9th Sept., 2023 on the following terms and conditions and as notified and accepted various State Governments, from time to time.

DECLARATIONS BY THE DISTRIBUTOR (SECOND PARTY)

I, the undersigned Distributor, hereby solemnly affirm and declare as follows:

SECTION 1: VOLUNTARY PARTICIPATION

1.1 Voluntary Decision: I am joining the Company's program completely voluntarily without any coercion, pressure, or undue influence from the Company or its representatives.

1.2 Independent Evaluation:  I have independently evaluated the business opportunity and am joining based on my own assessment and judgment.

1.3 No False Promises: I confirm that no one from the Company has made any specific income guarantees or assured me of any particular financial returns.

SECTION 2: UNDERSTANDING OF BUSINESS MODEL

2.1 Comprehension of System:  I have read, understood, and comprehend the Company's binary compensation plan including:

Binary Pair Matching
Binary pair calculations
Rank achievement requirements

2.2 Income Disclaimer:  I understand and acknowledge that:

Income potential depends entirely on my individual efforts and team building capabilities
The Company does not guarantee any specific income level
Past performance of other distributors does not guarantee my results

2.3 Multiple ID Policy:  I understand that if I choose to operate multiple IDs:

Each ID requires separate registration and course purchase
I am responsible for managing multiple accounts

SECTION 3: PRODUCT & SERVICE UNDERSTANDING

3.1 Skill Course Value:  I am purchasing the skill development course for its educational value and understand the business opportunity is additional.

3.2 No Product Returns: I understand that the digital skill development course is non-returnable and non-refundable once accessed.

3.3 Course Access:  I understand that course access is valid for one year from date of purchase, renewable annually.

SECTION 4: FINANCIAL RESPONSIBILITY

4.1 Personal Investment: The amount of ₹1,000 (+ GST) paid for the skill development course is:

A personal investment in my education
Paid willingly without any pressure
Not recoverable once the course is accessed

4.2 No Financial Pressure:  I confirm that no one has pressurized me financially or emotionally to join this program.

4.3 Source of Funds:  The funds used for this purchase are from legitimate sources and I am capable of bearing this financial commitment.

SECTION 5: INDEMNIFICATION

5.1 Non-Disparagement: The Distributor agrees not to make false, misleading, or defamatory statements about the Company, its products, services, or compensation plan.

5.2 Hold Harmless: The Distributor agrees to hold the Company harmless from any claims arising from:

Their inability to achieve desired income levels
Personal business decisions
Team management issues
Market conditions

5.3 Legal Costs: In case of frivolous litigation, the Distributor shall bear all legal costs incurred by the Company.


SECTION 6: COMPLIANCE & CONDUCT

6.1 Proper Representation: The Distributor agrees to:

Never make specific income claims to prospects
Not use false or misleading marketing tactics
Always present the business opportunity ethically

6.2 Policy Adherence:  The Distributor agrees to abide by the Company's:

Code of Conduct
Marketing Policies
Compensation Plan Rules

6.3 Multiple Account Responsibility: For multiple IDs, the Distributor accepts full responsibility for:

Managing separate teams
Maintaining ethical practices across all accounts
Not engaging in cross-sponsoring or team manipulation

SECTION 7: EXPLICIT UNDERSTANDING

I SPECIFICALLY ACKNOWLEDGE THAT I HAVE BEEN CLEARLY INFORMED ABOUT:

7.1 Income Realities:

Most distributors earn part-time income
Top earnings require significant team building efforts
Income is not automatic or guaranteed

7.2 Time Commitment:

Building a sustainable income requires consistent effort
There is no "get rich quick" formula
Success requires personal development and skill enhancement

7.3 Business Risks:

Like any business, there is risk of not achieving desired results
Team building depends on multiple factors beyond company control
Market conditions and individual effort significantly impact results

SECTION 9: LEGAL PROVISIONS

9.1 Governing Law:  This Agreement shall be governed by the laws of India.

9.2 Jurisdiction:  Any legal proceedings shall be subject to the jurisdiction of courts in Sonipat, Haryana.

9.3 Dispute Resolution: In case of disputes, parties agree to:

First attempt mediation
Then arbitration as per Indian Arbitration Act
Finally, legal recourse if unresolved

9.4 Severability: If any clause is found invalid, the remainder of the Agreement remains enforceable.

FINAL DECLARATION

I, THE DISTRIBUTOR, HEREBY SOLEMNLY AFFIRM THAT:

1. I have read and understood this entire Agreement
2. All information provided by me is true and correct
3. I am joining voluntarily without any false promises
4. I understand the business model and associated risks
5. I agree to abide by all Company policies
6. I take full responsibility for my business results

By clicking the agreed column, the second party undertakes that he / she / they have read & understood all the terms and conditions mentioned in the E-Contract & BE SELLFISH EDUCATION & ENTREPRENEURSHIP LLP’s financial Rewards System and agree to abide by them.
